Terms and Conditions of Rental

1. General Agreement

These Terms & Conditions constitute a legally binding agreement between Kogo Rentals (“Company”) and the renter (“Customer”). By taking possession of the vehicle, the Customer fully agrees to all terms stated herein.

2. Driver Eligibility

  • Minimum age: 21 years

  • Minimum driving experience: 2 years

  • Documentation: All drivers must present a valid driver’s license.

  • Additional drivers: Permitted only if registered in the agreement and approved by the Company.

3. Payment Terms

  • Full payment is required in cash at the time of vehicle delivery.

  • The Company reserves the right to refuse service if payment is not completed.

4. Security Deposit

  • A $50 security deposit is required before rental.

  • The Company reserves the right to deduct from the deposit for:

    • Cleaning fees

    • Smoking violations (€50 penalty)

    • Traffic fines or administrative costs

    • Minor damages

  • If costs exceed the deposit, the Customer agrees to pay the difference.

  • The remaining deposit is returned after vehicle inspection.

5. Insurance & Liability

Vehicles are provided with insurance coverage. However, the Customer bears full responsibility in cases including but not limited to:

  • Violation of traffic laws

  • Driving under the influence of alcohol or drugs

  • Unauthorized driver operating the vehicle

  • Failure to follow accident reporting procedures

Note: In such cases, the Customer may be held liable for full damage compensation.

6. Use of Vehicle (Strict Restrictions)

The following are strictly prohibited:

  • Off-road driving

  • Driving under the influence of alcohol or drugs

  • Smoking inside the vehicle (€50 penalty)

  • Use for taxi, ride-sharing, or delivery services

  • Subleasing or allowing unauthorized drivers

  • Taking the vehicle outside agreed территории without written permission

Violation of any of the above terms may result in immediate termination of the rental agreement without refund.

7. Fuel Policy

  • The vehicle is provided on a like-to-like fuel basis.

  • The Customer must return the vehicle with the same fuel level.

  • Missing fuel will be charged at market rates plus service fee.

8. Mileage Policy

  • Unlimited mileage is included unless otherwise agreed.

9. Delivery & Territory

  • Delivery Locations: Kutaisi Airport / Anywhere within Kutaisi.

  • Use outside Kutaisi or Georgia must be agreed in advance.

10. Rental Period & Late Return

  • The rental period is agreed in advance.

  • A grace period (if any) is agreed individually.

  • Late returns without approval may result in:

    • Additional daily rental charges

    • Penalty fees

  • If the vehicle is not returned, the Company reserves the right to repossess the vehicle without notice and report it to law enforcement.

11. Accidents & Damage Procedure

In case of accident or damage, the Customer must:

  1. Stop the vehicle immediately.

  2. Do not move the vehicle unless necessary for safety.

  3. Contact the Company immediately.

  4. Contact police and/or insurance if required.

    Failure to follow these steps results in full liability for all damages.

12. Vehicle Condition

  • Vehicle condition is documented with photo and video evidence before rental.

  • The Customer agrees to return the vehicle in the same condition.

  • Additional cleaning or damage fees may apply.

13. Theft / Total Loss

  • Immediately notify the Company and police.

  • If negligence, misuse, or violation of terms is involved, the Customer may be liable for the full value of the vehicle.

14. Cancellation Policy

  • Free cancellation is allowed prior to the rental start time.

  • Failure to appear (no-show) may result in refusal of future bookings.

15. Right to Terminate

The Company reserves the right to terminate the agreement at any time if terms are violated, the vehicle is misused, or payment obligations are not met. No refund will be issued in such cases.

16. Governing Law

  • This agreement is governed by the laws of Georgia.

  • Any disputes shall be resolved under Georgian jurisdiction.

18. Acceptance of Terms

By renting the vehicle, the Customer confirms that they:

  • Have read, understood, and accepted all Terms & Conditions.

  • Agree to be legally bound by this agreement.
